OSEP Requirements

On August of 2021, the Texas Education Agency (TEA) received a response from the Office of Special Education Programs (OSEP) regarding the documents TEA submitted to OSEP in November of 2020 related to Texas’ corrective action response. In the response, OSEP outlined the four new requirements of Texas Local Education Agencies (LEAs) described below.

In 2019, the 86th Texas Legislature passed Senate Bill 139 (SB 139). These notices provide information of the rights of a child regarding the provision of special education services under both state and federal laws. Also information about the process, procedures for initiating a referral for evaluation for special education services under the Individuals with Disabilities Education Act (IDEA) and TEC Sec. 29.004.

The following link contains the information in the document related to SB 139 mentioned in OSEP Requirement 2. This is intended to provide Texas families with information regarding the Individuals with Disabilities Education Act (IDEA), Dyslexia, Multi-Tiered Systems of Support, and Section 504 of the Rehabilitation Act of 1973.

OSEP Requirement 4

The following TEA-developed document is intended to assist parents whose children may have been previously delayed or denied an evaluation under the IDEA in requesting compensatory services for their child.
