On August of 2021, the Texas Education Agency (TEA) received a response from the Office of Special Education Programs (OSEP) regarding the documents TEA submitted to OSEP in November of 2020 related to Texas’ corrective action response. In the response, OSEP outlined the four new requirements of Texas Local Education Agencies (LEAs) described below.

In 2019, the 86^th Texas Legislature passed Senate Bill 139 (SB 139). These notices provide information of the rights of a child regarding the provision of special education services under both state and federal laws. Also information about the process, procedures for initiating a referral for evaluation for special education services under the Individuals with Disabilities Education Act (IDEA) and TEC Sec. 29.004.
